Clarification on leave to remove

Sir Nicholas Wall, the President of the Family Division clarifies the court's position on leave to remove cases.

Susan Taylor, Principal Solicitor at Taylor King, said, "Disputes involving children will always be complicated. This is because the court has a huge scope for discretion, and the court's determination of the 'best interests' test can be hard to predict. I would advise all clients to attempt to settle disputes by way of mutual compromise and agreement before recourse to the court is considered."
